These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Enacti Ventures Private Limited ("Company," "we," "us," or "our"), a company incorporated and registered under the laws of India, with its principal place of business in Panchkula, Haryana, India.
By downloading, installing, accessing, or using the Smart Printer mobile application (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the App.
Smart Printer is a mobile application that enables users to print documents, photos, contact lists, and other content wirelessly from their iOS devices. The App provides the following features:
The App is available in both a free version (with advertisements) and a premium subscription version (Smart Printer Pro) with enhanced features and an ad-free experience.
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use this App. If you are under 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the App, you represent and warrant that you have the legal capacity to enter into these Terms and that your use of the App complies with all applicable laws and regulations in your jurisdiction.
The App does not require you to create a user account. Your subscription and purchase history is managed through your Apple ID and the Apple App Store.

You may restore previously purchased subscriptions on any device signed in with the same Apple ID by using the "Restore Purchases" option within the App.
We may offer free trial periods for Smart Printer Pro subscriptions. The following terms apply:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use.

The App, including but not limited to its source code, design, layout, graphics, user interface, animations, logos, trademarks, and all content provided by us, is the exclusive property of Enacti Ventures Private Limited and is protected by applicable intellectual property laws of India and international treaties.
The "Smart Printer" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Enacti Ventures Private Limited. You may not use such marks without our prior written permission.
All third-party trademarks, service marks, logos, and trade names appearing in the App are the property of their respective owners.
You retain all ownership rights in the content you process through the App, including documents, photos, contacts, text, and drawings ("User Content").
You represent and warrant that:
We do not claim ownership of your User Content. Content processed through the App for printing is handled locally on your device and is not uploaded to our servers.
You agree not to use the App to:
We reserve the right to terminate or suspend your access to the App immediately, without prior notice, if we determine that you have violated any of these prohibited conduct provisions.
The App integrates with and relies upon third-party services including, but not limited to:
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party service. The inclusion of third-party services does not imply our endorsement of those services.
The free version of the App displays advertisements served by Google AdMob. By using the free version, you agree to the display of advertisements within the App.
We are not responsible for the content, accuracy, or availability of advertisements displayed in the App. Any interaction with advertisements, including purchasing products or services advertised, is solely between you and the advertiser. We are not liable for any loss or damage resulting from your interactions with advertisers.
Upgrading to Smart Printer Pro removes all advertisements from the App.
To the fullest extent permitted by applicable law, Enacti Ventures Private Limited expressly disclaims all warranties, including but not limited to:
You acknowledge and agree that your use of the App is at your sole risk. We do not warrant that the App will meet your specific requirements or expectations.
No advice or information, whether oral or written, obtained from us or through the App shall create any warranty not expressly stated in these Terms.
This limitation applies to, but is not limited to, damages arising from:
In no event shall our total aggregate liability to you for all claims arising from or relating to the use of the App exceed the amount you actually paid to us for the App in the twelve (12) months immediately preceding the event giving rise to the claim, or One Hundred Indian Rupees (INR 100), whichever is lower.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Enacti Ventures Private Limited, its directors, officers, employees, affiliates, agents, contractors, and licensors from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
This indemnification obligation shall survive the termination of these Terms and your use of the App.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Panchkula, Haryana, India.
You irrevocably and unconditionally:
Before initiating any legal proceedings, you agree to first contact us at services@enacti.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute cannot be resolved informally, either party may initiate legal proceedings in the courts of Panchkula, Haryana, India.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

Termination of these Terms does not entitle you to any refund of subscription fees already paid. Active subscriptions must be cancelled through your Apple ID Account Settings.
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Changes will be effective immediately upon posting the revised Terms within the App or on our website.
The "Last Updated" date at the top of these Terms will be revised to reflect the date of the most recent changes. Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.
It is your responsibility to review these Terms periodically. If you do not agree with any modification, your sole remedy is to discontinue use of the App.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and Enacti Ventures Private Limited regarding your use of the App, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
