Terms and Conditions

By downloading, installing, accessing, or using the "Find My Car - Car Tracker" (hereinafter referred to as "the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately uninstall and cease all use of the App.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and the developer of Find My Car - Car Tracker ("we", "us", or "our"). We reserve the right to modify these Terms at any time without prior notice. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.

The App is designed to help users mark and locate their parked vehicle. The App provides features including but not limited to GPS-based car location marking, augmented reality navigation, radar view, and photo/notes functionality.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the App will be uninterrupted, error-free, accurate, reliable, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, reliability, or precision of GPS data, location tracking, or navigation features.
• Any warranty that the App will meet your specific requirements or expectations.

You acknowledge and agree that the use of the App is entirely at your own risk. We do not warrant that location data, directions, distance calculations, or any other information provided by the App will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of or damage to your vehicle, personal property, or any third-party property.
• Personal injury, bodily harm, or death arising from or related to the use or inability to use the App.
• Inaccurate location data, GPS errors, or failure to locate a vehicle.
• Loss of data, revenue, profits, goodwill, or any other intangible losses.
• Any damages arising from unauthorized access to or alteration of your data.
• Any matter related to the App, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

In any case, our aggregate liability to you for all claims arising out of or relating to the use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or INR 500 (Indian Rupees Five Hundred), whichever is lesser.

You agree to defend, indemnify, and hold harmless the developer, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the App.
• Your violation of any provision of these Terms.
• Your violation of any third-party right, including any intellectual property or privacy right.
• Any claim that your use of the App caused damage to a third party.

The App offers the following subscription plans and in-app purchases:

• Weekly Subscription: Auto-renewable subscription billed every week. Provides access to premium features for the subscription period.
• Annual Subscription: Auto-renewable subscription billed every year. Provides access to premium features for the subscription period.
• Lifetime Access: A one-time, non-renewable in-app purchase that grants permanent access to premium features.

Auto-Renewable Subscriptions:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Lifetime (Non-Renewable) Purchase:

• This is a one-time purchase and does not auto-renew.
• Once purchased, premium features are unlocked permanently on the Apple ID used for the purchase.

The App uses Google AdMob SDK to display advertisements. By using the App, you acknowledge and agree that:

• Third-party advertisements may be displayed within the App.
• Ad content is provided by third-party advertisers and ad networks; we do not endorse or guarantee any products or services advertised.
• AdMob may use cookies, device identifiers, and other tracking technologies to serve personalized ads in accordance with Google's Privacy Policy.
• We are not responsible for the content, accuracy, or availability of third-party advertisements or the products/services they promote.

The App requires access to certain device features to function properly:

• Location Services: Required to mark your car's location and provide navigation back to it. The App may use your location data while the app is in use.
• Camera: Required for augmented reality features and to take photos of your parking location.

You may revoke these permissions at any time through your device settings. However, doing so may limit or disable certain features of the App. We are not responsible for any loss of functionality resulting from denied permissions.

By using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Not rely solely on the App for locating your vehicle, especially in emergency situations.
• Ensure that your device has adequate battery, GPS signal, and internet connectivity for the App to function.
• Not use the App while driving or operating a vehicle.
• Not attempt to reverse-engineer, decompile, disassemble, or otherwise tamper with the App.
• Not use the App for any illegal, unauthorized, or harmful purpose including but not limited to tracking vehicles or persons without consent.

All intellectual property rights in and to the App, including but not limited to its source code, design, graphics, logos, trademarks, and content, are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App or any part thereof without our prior written consent.

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitation of liability.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any cause of action or claim you may have with respect to the App must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter hereof.
